When installing this Mobile Application (hereinafter, the Application), the user declares that he/she has read and accepted the Terms and Conditions of Use which he/she is obliged to comply. Fundación Mapfre and FUNDACIÓN Gmp (hereinafter, the Companies), reserve the exclusive right to change, modify, add or eliminate clauses in these Terms and Conditions at any time and without previous notice, with the understanding that by continuing to use the Application the user has accepted these modifications.
Access to and download of the application is free of charge except for the connection cost via the telecommunications network provided by the access provider contracted by the user.
Mobile Application is understood to be software together with other possible components provided by the Companies to be used in mobile devices with Android operating systems, together with the corresponding periodic updates.
Under no circumstances will the owner of Google Play be considered responsible for the application, or the way in which it is used.
Admission
This Application is for the sole use of users over 14 years old. Otherwise it will be considered a breach of the Terms and Conditions.
The User should notify the end-users of the application of the content of these Terms and Conditions. Where the end-users of the application are minors or legally incapacitated adults, the user should also notify their legal representatives.
User conduct
The User acknowledges and accepts that the use of the services offered in this Application will be made at the risk of the user and under his/her sole and exclusive responsibility. The User agrees to use this Application and its services in accordance with the Law, common decency, public order and the Terms and Conditions included herein.
Provided that it is applicable, and by way of example, but not limited to or exclusively, the User agrees not to use the Application for the following purposes:
- Publish, transmit or share comments that are harmful, threatening, illegal, libelous, injurious, offensive, calumnious, infringing, abusive, incendiary, harassing, vulgar, obscene, fraudulent, or take any action that interferes with or that violates the right to privacy, honor and self-image, that is malicious or questionable for reasons of race, ethnicity, religion or any other, with respect to any individual or corporation.
- Violate the security measures established in the Application or use it in an illegal manner.
- Publish, transmit, share or enable comments that constitute, incite or provide instructions to commit crimes, that violate the rights of a third party, give rise to responsibilities or infringe any local, national or international Law.
The Companies reserve the right to delete these comments and even to remove the user that infringes these conditions.
Intellectual property rights regarding the Application
All of the Application’s components are the exclusive property of the Companies.
No part of the Application may be modified, copied, distributed, framed, reproduced, downloaded, displayed, published, transmitted or sold in any way or through any medium, completely or partially, without previous written consent from the Companies.
It is strictly prohibited to use the Application in any way that is different from what is authorized in these Terms and Conditions, without previous written consent from the Companies.
Providing the user is legitimized to use the Application, the Companies grant the user limited license to use and access the Application and only for personal and professional use, and never commercial, providing the user respects all warnings regarding copyright and intellectual property . Any other use of the Application is strictly prohibited.
Exclusion of responsibility
The Companies are not responsible for the use of the Application by the users or third parties. Furthermore, they will not be responsible for any damage or disorder in the user’s equipment or devices as a result of the installation or use of the Application, as well as errors, omissions, interruptions, eliminations, defects, functionality or transmission delays, failure in the communication lines or disorders in the User’s communications.
The Companies reserve the right to execute at any time and without previous notice, as many modifications, periodic updates, variations, eliminations or cancellations in the software and other components used or included in the Application that they consider necessary in order to add new functions and services, and the user should ensure that the latest version is used at all times.
Under no circumstances will Google Play be considered a sponsor of the application or of any of the activities that are performed or established via the application.
Termination
With previous notice to the user, the Companies may terminate the use of the Application at any time, ending all rights and licenses granted to the user.
